Terms of Service

The conditions for using this service, and what happens when something goes wrong.

The clauses shown in bold are the ones that matter most — the limits of liability, governing law and jurisdiction, and your obligations.

What this service does

This service publishes unsolved problems of the world as 13-block records. The sentences in those records are ours — we take facts from public reporting and public data and write them again ourselves; we do not republish someone else's text. For those records we are therefore a publisher, not an intermediary, and the content is our responsibility. Comments, nicknames, and pictures posted by users belong to whoever posted them, and the "Reporting infringement" procedure below applies to those. Reading requires no sign-in; commenting and voting do.

What you post

Comment text, nicknames, and profile pictures are posted by you. Three things must be clear. First, all three appear on public pages as given and are collected by search engines and AI crawlers — once posted, this cannot be undone. Second, the copyright stays with you; we do not take it. You are, however, taken to permit us to reproduce and transmit it to the extent needed to publish and display it on this service. Third, please post only what you have the right to post — if you post someone else's photo, writing, or personal information, that is on you. You can delete your own comments from the account page and from where the comment stands.

What is prohibited (your obligations)

The following must not be posted. Anything infringing another's copyright, trademark, or other rights. Anything defaming or insulting a specific person. Personal information about someone other than yourself (name, contact details, address, photograph, and so on) revealed without their consent. Information prohibited by law. Advertising, promotion, or repeated posting that obstructs other readers. Sending bulk automated requests or otherwise interfering with normal operation. Impersonating another person. Posts breaching this clause may be taken down under the procedure below, and repeated breaches may result in writing access being blocked.

Reporting infringement, and how it is handled

If you believe something published here infringes your rights, tell us at ponderloft@gmail.com. Both copyright infringement reports and other rights infringement reports are received at that address. We designate this address, and give public notice of it, as the recipient for requests to suspend reproduction or transmission under Article 103(4) of the Korean Copyright Act. Infringement notifications under 17 U.S.C. §512 are received at the same address. Including the following speeds up handling: the address (URL) of the post in question, which right is infringed and how, your name and contact details, and a statement that what you report is accurate.

Once received, we check without delay and, where we judge there is infringement, delete the post or block access to it. Where infringement is hard to judge, we may block access temporarily for a period not exceeding 30 days. We notify both the person who reported and the person who posted of the outcome. We do not review posts in advance — we act once we know.

Reporting and interim measures on the page

Every comment carries a report button. Only signed-in users can report, and one person can report the same comment once. The reason is chosen from: spam or advertising, abuse or harassment, hate speech, sexual or unsuitable for minors, personal information exposed, rights infringement, other.

Once three different people report the same comment, it is hidden automatically. While hidden its text is shown to nobody on the page. The author, however, can still read their own text under My activity — you must know what the decision is about in order to appeal it. The place on the page reads "Reported — under review", and the comment accepts no further replies, votes or reports. While hidden the author cannot delete it either — something must remain in order to be appealed. Below three reports nothing changes on screen; only the report record is kept.

A report you filed can be withdrawn. Use Cancel report under Reports you filed on the notifications page. A withdrawn report no longer counts toward the threshold, so if the remaining reports fall below three, a hidden comment becomes visible again. A report the operator has already judged cannot be withdrawn, and a comment made private does not come back when reports are withdrawn — that decision was the operator's. The record of the withdrawal is kept, not deleted.

Hidden comments are reviewed by the operator. If there is no problem the text is restored; if there is, the comment is made private. A comment made private is kept rather than deleted, so it can be restored on appeal. After a restore, earlier reports are not counted again — three different people must report it afresh.

Nicknames and photos also carry a report button. It opens from the face beside a comment, and the reasons and conditions are the same as for comments. Once three different people report the same user's display information, that nickname and photo are hidden automatically. While hidden they are not shown to other users and the per-problem six-character mark is shown instead, and the owner cannot change the values either — what the operator reviews must not shift, and there must be no way to escape the hiding by editing a single character. Display-information reports can be withdrawn the same way.

Hiding is not deleting. The values remain and the nickname stays unavailable to anyone else — that is what makes a restore possible if no problem is found. If the operator finds a problem, the nickname and photo are then deleted and the user returns to being an unnamed contributor. The account itself is untouched and a new name can be chosen. Either way the outcome is told to the person concerned.

This procedure differs from a rights-infringement report. Matters that need substantiation, such as copyright infringement or defamation, are not handled by this button; use the email address given in the clause above. The outcome of a report, and what happened to your own posts, appear on the notifications page.

Appeals

If your post has been taken down or temporarily hidden, you may appeal to the same address. We will look again and tell you the outcome. As a rule, when we take something down we tell the person who posted it why. We may not do so where the post plainly breaks the law, or where telling would make the harm worse.

Repeat infringement

For users who repeatedly infringe the rights of others, we may suspend or terminate the account in appropriate circumstances. What counts as repeated is judged on the number and seriousness of the infringements and whether they were deliberate.

Designated agent under US copyright law

17 U.S.C. §512(c)(2) requires a service provider to register a designated agent to receive notifications of claimed infringement with the US Copyright Office, and to make that information available to the public through its service. The following is published under that provision.

Notifications of claimed infringement under US copyright law are received at the address above. The designation of a recipient under Article 103(4) of the Korean Copyright Act is given separately in the “Reporting infringement, and how it is handled” clause above; the two regimes are independent. If this information changes, we update this page and the US Copyright Office registration together.

On the accuracy of the records

The problem records published here are our own summaries of public material. We try to be accurate, but the source itself may be wrong, circumstances may have changed with time, or we may have misread. So do not rely on these records as the basis for a decision, an investment, or a legal judgement. The last block of each record carries its sources — where a judgement matters, please check the originals yourself. If you find an error, tell us at the address above and we will check and correct it.

Advertising

This service may carry advertising supplied by third parties. The content of those advertisements is determined by the party supplying them; we neither choose nor endorse it. What happens on a site you reach through an advertisement is governed by that site's terms. Cookies used with advertising are described in the "Cookies" clause of the privacy policy, this service serves advertising only after consent is given, and serves no advertising at all in the European Economic Area, the United Kingdom, or Switzerland.

Minors

This service is not directed to children and does not ask for age. The threshold differs by country: under 14 in Korea, under 13 in the United States. If we learn that something was posted by a child below those ages, we remove it after checking — the details are set out in the "Children under 14" clause of the privacy policy. Parents and guardians: parental control programs and services that help manage a child's internet use are commercially available, and you may wish to use them.

Limits of liability

This service is provided free of charge and as-is. We will work to avoid interruptions and data loss, but we do not warrant that they will never happen. Where a post by one user causes loss to another user or to a third party, that is the responsibility of whoever posted it. This clause does not apply, however, to loss caused by our own intent or gross negligence, nor where the law does not permit liability to be limited. Rights the law grants you as a consumer are not reduced by these terms.

Governing law and jurisdiction

These terms and the use of this service are governed by the law of the Republic of Korea. Disputes are subject to the Seoul Central District Court as the court of first instance. Where you are a consumer, however, this clause does not deprive you of the protection given to you by the law of the country of your habitual residence, nor does it exclude the jurisdiction that country's law provides.

Changes to these terms

If these terms change, the change is posted on this page. The date they were last revised is the recorded-on date in the heading above. There is currently no place that shows the before and after side by side — the revision history lives only in the repository's change log, and the page carries only the latest version.

Operator and contact

Infringement reports, appeals, and other enquiries are received at ponderloft@gmail.com. Privacy enquiries go to the same address — please also see the "Privacy officer and contact" clause of the privacy policy.

The operator’s representative name, address, telephone number, and business name are stated in the “Designated agent under US copyright law” clause above. What we previously declined to state has changed — 17 U.S.C. §512(c)(2) requires that publication as a condition of the safe harbour, and since this service accepts user posts we chose to meet that condition. This is not because Korean law requires it. The business registration number is still not stated — this service sells no goods or services to visitors, so it is not subject to the disclosure required by Korea’s Act on Consumer Protection in Electronic Commerce, and no other law here or abroad requires it. If this service begins taking payment from visitors, Article 10 of that Act requires six items at once, and this field would be filled then. There is no such plan at present.
