What is happening?

A binding global agreement against harmful fishing subsidies exists, is in force, and carries a clause that ends it if the next stage of negotiation does not finish in time.

The WTO Agreement on Fisheries Subsidies was adopted at the Twelfth Ministerial Conference on 2022-06-17. Article 3 prohibits subsidies to illegal, unreported and unregulated fishing. Article 4 prohibits subsidies to fishing of stocks already assessed as overfished. Article 5 prohibits subsidies to fishing on the high seas outside the jurisdiction of coastal members and outside the competence of any relevant regional fisheries management organization or arrangement. The agreement needed acceptance by two thirds of the membership to enter into force, and it crossed that threshold and entered into force on 2025-09-15.

Article 12 attaches a clock to the whole agreement. If comprehensive disciplines are not adopted within four years of entry into force, and unless the General Council decides otherwise, the agreement stands terminated immediately. The comprehensive disciplines meant here are the second phase of the negotiation, covering subsidies that contribute to overcapacity and overfishing in general. The text counts four years from entry into force and does not print a calendar date; counting four years from 2025-09-15 gives 2029-09-15.

Those disciplines have now missed two ministerial conferences. At the Thirteenth Ministerial Conference, which closed in early March 2024, the second phase was not concluded. At the Fourteenth, reported by the WTO on 2026-03-30, ministers agreed to keep negotiating with the aim of delivering recommendations on the comprehensive disciplines referred to in Article 12 to the Fifteenth Ministerial Conference. No date for that conference appears in any source opened here.

As of 2026-10-04 the WTO acceptance page lists 123 of the 166 members as having deposited their acceptance. On the day of entry into force the WTO Director-General said that having all members ratify by the Fourteenth Ministerial Conference was among the main hopes. That conference has passed and 43 members, on those two counts, have not accepted.

The usual cost of a failed negotiation is that nothing new happens, but here the cost of failure is that something already agreed disappears. That inversion is the whole of what this document describes, and it holds whatever one thinks the second phase ought to say.

What it should be

The target state is written by the membership itself, in the agreement and in the ministerial decision. Article 12 sets it: comprehensive disciplines adopted within four years of entry into force, which is the condition under which the agreement continues on its own terms. The Fourteenth Ministerial Conference restated the route to it, directing negotiation toward recommendations for the Fifteenth. Neither text says what the disciplines must contain, and this document does not supply a content target in their place.

How big is it?

The magnitudes the opened sources carry are institutional rather than a headcount of affected people.

Membership scale. The WTO had 166 members on its own page as of 2026-10-04. The acceptance page lists 123 acceptances as of the same date, which leaves 43 members that have not accepted on those two counts. No opened source performs that subtraction.

Time scale. Counting four years from entry into force on 2025-09-15 gives 2029-09-15, which leaves a little under three years from 2026-10-04. Two ministerial conferences, in 2024 and 2026, have already passed without the second phase, and no opened source gives the date of the next one.

Resource scale. A data publication restating figures from the Food and Agriculture Organization reports that a little over one third of assessed fish stocks were fished at biologically unsustainable levels on 2021 data. The WTO negotiations page describes subsidies as one of the factors behind that pressure. The FAO original could not be opened, so this figure stands one step removed from its source.

No affected population is derivable. The chain that would produce one runs from termination of the agreement, through the return of subsidies it currently prohibits, to further depletion of stocks, to harm to people who fish. Every link in that chain is a forecast rather than an observation, and no opened source quantifies any of them. A count of fisheries workers is circulated, but no opened page confirmed it, so it is not used.

Under what conditions does it arise?

1. The default outcome is termination rather than standstill. In most negotiations a failure to agree leaves existing rules where they are. Article 12 reverses that: unless the membership adopts the comprehensive disciplines or the General Council decides otherwise, the agreement already in force stands terminated. The outcome that needs no decision is the loss of the first phase.

2. The two phases cover different ground. The first phase covers three defined categories, namely illegal fishing, stocks already overfished and the unregulated high seas. The second reaches subsidies that contribute to overcapacity and overfishing in general, and that is where both ministerial conferences stopped. A news report on the conference that closed in March 2024 recorded the WTO Director-General as saying one or two issues could not be bridged.

3. Agreement needs the membership as a whole. The comprehensive disciplines have to be adopted by the membership, and a ministerial conference that ends without agreement produces a decision to keep negotiating rather than a text. That is what happened in March 2024 and again in March 2026.

4. The escape valve is itself a collective decision. Article 12 allows the General Council to decide otherwise, which is the only route to survival that does not run through the second phase. It too needs the membership to agree, so it moves the same requirement to a different room rather than removing it.

5. The calendar of ministerial conferences sets the pace. The negotiating mandate now points at the Fifteenth Ministerial Conference, and no opened source gives its date. A clock that counts in years is being matched against a meeting cycle that counts in conferences, and the two are not aligned anywhere in the text.

Each attempt so far has produced either acceptance of the first phase or a renewed mandate for the second, and none has produced the text that Article 12 asks for. The acceptances lengthen the list of members bound by an agreement whose survival depends on a negotiation that has now moved past two conferences.

Why is it still unsolved?

Coordination failure — the second phase needs the whole membership to agree, and the cost of not agreeing falls on an agreement that the membership has already made.

The clause ties the survival of the first phase to the completion of the second. The second phase still needs the membership to agree on a text that two ministerial conferences have not produced, and the clock attaches a consequence to that outcome without adding any means of reaching agreement.

The second part is that the only alternative to the second phase is another collective decision. The General Council can decide that the agreement continues, but that decision needs the same membership to agree in a different forum. So both routes to survival, adopting the disciplines or deciding otherwise, run through collective agreement, and the route that requires no agreement at all is termination.

The third part is timing. The four-year period runs from a fixed date while the negotiation runs from conference to conference, and the mandate now points at a conference whose date no opened source gives. Each conference that ends with a decision to keep negotiating consumes part of a fixed period without changing anything about the requirement, and nothing in the opened record ties the pace of negotiation to the date on which the clock runs out.

What observation would mean it is solved?

Candidates — (a) the membership adopts comprehensive disciplines on subsidies contributing to overcapacity and overfishing before 2029-09-15 (b) the General Council adopts a decision under Article 12 that the agreement continues (c) acceptances reach the full membership of 166.

(a) is the condition the text itself names. It is also the only one of the three that both keeps the first phase alive and extends discipline to the subsidies the first phase does not reach. Even so, adoption is a different event from entry into force, and the first phase took more than three years to go from adoption to force.

(b) alone is a survival, not a solution. A decision that the agreement continues would stop the clock, but it would leave the second phase exactly where it is, and the subsidies that build overcapacity would remain outside any binding rule.

(c) alone measures reach, not durability. Every member could accept the first phase and the agreement would still stand terminated on the same date if neither (a) nor (b) occurs. Read together, (a) tests whether the negotiation finishes, (b) tests whether the first phase survives without it, and (c) tests how far the first phase extends while it lasts.

What is it connected to?

The connections the opened sources establish are three. Dispute settlement: Article 10 of the agreement draws on the general dispute settlement rules of the WTO, so disputes under it run into the same appellate stage that is described in the document on the Appellate Body vacancy. Regional fisheries bodies: Article 5 defines one of its prohibitions by reference to the competence of regional fisheries management organizations and arrangements, so the reach of that prohibition depends on how far those bodies extend. The state of fish stocks: the WTO negotiations page links the subsidies it addresses to overfishing, and the share of stocks fished at unsustainable levels is the condition the agreement exists to change. The relation type in each case is a dependency named in the legal text or on the WTO page; the first two links rest on the legal text and are high grade, while the stock figure behind the third is medium grade.

  • Which members held up agreement on the second phase. The WTO record opened here, both the news item of 2026-03-30 and the briefing note, attributes the outcome to no member. No source opened here carries a published statement from any member explaining its position on the outstanding issues, so no member position is carried in this document.
  • The current state of the draft text. Negotiating drafts for the second phase are not on any page opened here, so this document cannot say which issues remain open or how far apart the positions are.
  • The formal decision rule for adopting the comprehensive disciplines or a General Council decision under Article 12. No source opened here states it, so this document says only that both need the membership to agree.
  • Whether the General Council will decide that the agreement continues. That is a forecast. The opened sources establish only that Article 12 provides for such a decision.
  • When the Fifteenth Ministerial Conference will meet. No source opened here gives a date, so this document cannot say whether it falls before or after 2029-09-15.
  • Whether any dispute has been brought under the agreement since 2025-09-15. No source opened here reports one, and that silence is not evidence that none exists.
  • The global value of harmful fisheries subsidies, with a base year. The pages that would carry it returned errors, and a figure seen in search results could not be tied to a year, so no value is carried.

Most of what this document rests on is the WTO describing its own agreement. The legal text, the acceptance page, the entry into force release, the negotiations page, the news item of 2026-03-30 and the briefing note were opened directly, and between them they supply the termination condition, the prohibitions, the dispute settlement route, the entry into force date, the acceptance count, the membership total and the outcome of the Fourteenth Ministerial Conference. Two facts rest on secondary sources: the outcome of the Thirteenth Ministerial Conference comes from a news report rather than a WTO document, and the share of overfished stocks comes from a publication restating FAO data whose original could not be opened. The calendar date 2029-09-15 is derived by counting four years from the entry into force date and does not appear in the text. Six sources could not be opened and are left visible with their reasons rather than replaced, and nothing from them is carried in the body.
